Perimeter Block Walls and Wrought Iron Fences

As the community matures there is a growing need for attention on maintaining the infrastructure that includes roads, lights, sidewalks, block walls and fences. Everyone needs to do their part in helping to keep Encinitas Ranch in good condition.

This article is intended to reinforce several important articles in our CC&R’s that relate specifically to exterior walls and fences as well as the responsibilities of the community and individual homeowners. 

9.1.7 Exterior Walls and Fences. The Community Association shall maintain the exterior (defined to mean the side fronting on any public right-of-way or Community Common Area) of any Perimeter Walls or Fences designated in a Supplementary Declaration and shall repair and replace, as necessary, such Perimeter Walls or Fences, unless otherwise specified on a Supplementary Declaration. Except as may otherwise be provided in a Supplementary Declaration, the Community Association shall be responsible for maintaining, repairing and replacing all wrought iron fencing or tubular steel fencing bordering any Lots or Community Common Area. If any wrought iron fencing or tubular steel fencing is attached to a wall, the Owner of the Lot bordering the wall shall maintain the interior of the wall and the Association shall maintain the exterior and top of the wall and be responsible for the repair and replacement of the wall.

The community conducts quarterly inspections of all infrastructure that includes the perimeter block walls and wrought iron fences. Any necessary repairs that are the result of normal degradation will be made by the community assuming that the problem was not a result of any damages from within the adjoining property. However,  if it is determined that the damage was caused from within the adjoining property, the owner will be responsible to either repair such damage or reimburse the communitiy for costs incurred.

9.2.3 Repair Damage. In the event the Community Board shall determine that the Lot perimeter walls and fences, if any, have been damaged from within the Lot, notwithstanding that such damage may be to the Lot perimeter walls and fences which are to be maintained by the Community Association pursuant to the terms of this Article, the Owner of the Lot shall be responsible for, at the election of the Community Board, (a) repairing such damage or (b) reimbursing the Community Association for costs incurred to repair such damage, all in a timely manner and in accordance with such rules as the Community Board or Architectural Committee shall from time to time adopt.

Finally, this is a reminder that homeowners shall not hang or attach any item (especially combustible materials) on or over any perimeter walls, pilasters or fences or Community Association fences or walls. Many homes within Encinitas Ranch area located within the Very High Fire Hazard Severity Zone (VHFHSZ) designation. It the Owner’s responsibility to understand and comply with all applicable fire
safety requirements and restrictions. (Reference Article 4.15 in the Architectural Standards)
