There are an increasing number of basketball hoops in the community and with them comes an increase in potential safety and liabilty issues both for the owner and the association. So, help is needed from owners with basketball hoops to understand the guidelines for their use.
There is specific language in our Architectural Standards about the use of basketball hoops:
4.18 Basketball Hoops and Fixed Sports Apparatus
Permanent installation of basketball hoops and other similar sports/play apparatus in the front or sides of a Lot are subject to the approval of the Architectural Committee. No apparatus may be attached to the perimeter fences. The AC will consider basketball hoop installations adjacent to the driveway provided the location does not encourage play on any street or otherwise adversely affect adjacent properties. Backyard installations do not require an application provided the following design guidelines are met: maintain a minimum ten (10) foot setback from all perimeter fences and the residence, conform to all building code requirements, and do not exceed twelve (12) feet in height. Any variance from these guidelines will require an application.
It is important to understand these use restrictions. We encourage children to play in the neighborhood but parents need to be very watchful to avoid accidents. We encourage owners to place the basketball hoop on or very close to the curb and to install reflective tape on the post so that drivers at night can see the basketball hoop. We do not want anyone running into a basketball hoop with a vehicle. That would result not only in serious damage but create enormous liability for the owner and association.
